Terms & Conditions

GENERAL

The Triangle Partnership Limited (“Triangle”) effects introductions between companies, partnerships or other employees or potential partners. These terms apply to such services of introduction provided by Triangle and will apply unless a prior variation or other formal terms and conditions has been agreed, in writing, by a Director of Triangle Partnership Limited.

All references to employer, employee, employment, offer of employment, salary and any other words or phrases that are applicable to the relationship of employer and employee shall also be construed as references to the relationship of firm and Partner as if a partner were an employee.

Fees are chargeable and become due seven days from the date the hired individual commences employed with the client.

Contingency Fees: Fees are calculated at between 17.5% and 25% of the annual salary and are payable on the employee’s start date with the client. The percentage fee reflects the difficulty and/or complexity of the recruitment excercise and the degree of exclusivity Triangle will enjoy.

Search & Selection Fees: Fees are calculated at 25% of the projected annual salary and payable as detailed in point 5 below. 

RECRUITMENT FEE CALCULATION

1. Fees are charged for each introduction of an employee and are calculated as a percentage of the total remuneration in the first year of employment. The new employee’s total remuneration is defined as salary and/or profit share together with any bonuses, shift allowances, guarantees or similar taxable allowances. Employers undertake to inform Triangle in writing of the terms of employment agreed with a person introduced by Triangle and to provide such information in writing that may be necessary to calculate fees payable.

2. Where a company car is provided this will be considered to be equivalent to an additional salary of £3,000 per annum.

3. Where for whatever reason the projected total remuneration in the first year of employment cannot be agreed, Triangle reserves the right to calculate its fees on its own projection of total remuneration.

4. Triangle reserves the right to charge an additional fee based upon actual total remuneration in the first year when actual remuneration is materially different from the projected remuneration used in calculating the initial fee. Employers undertake to supply Triangle with such information in writing as may be necessary to calculate such additional fee. 

5. Search & Selection Fees: Fees are payable as detailed below.

  • Assignment Commencement: One third of the fee based on the best estimate of the potential employee’s first year’s annual salary is payable on the commencement of the recruitment assignment.
  • Candidate Shortlist: One third of the fee based on the best estimate of the potential employee’s first year’s annual salary is payable on the presentation of a shortlist of best candidate’s. Where this comprises of only one candidate this part of the fee will become when the decision is made to interview the candidate.
  • Candidate Employment: The balance of the assignment fee, based on the employee’s actual salary and benefits will become payable on the employee’s start date with the client. 

 RECRUITMENT FEE REFUNDS

  • Refunds on fees charged are payable if the employee hired leaves the client within eight weeks of the commencement of the individual's employment. Calculations are based on a pro rata refund over the eight-week period.
  • All refunds are subject to the strict condition that the recruitment fees have been paid within Triangle Partnership's terms and conditions of business as detailed on each invoice or other terms, formally agreed.
  • For Search & Selection assignments only, the “candidate employment” element of the fee, as described in 5 above, will be subject to a refund.
